OFW Authors 3rd Edition of the Food Products Recall Manual

[WASHINGTON-March 25, 2009] Olsson Frank Weeda Terman Bode Matz PC has authored the revised "Food Product Recall Manual, 3rd Edition." With the recent salmonella outbreak and its effect on the industry and lawmakers, there will be less tolerance for companies that do not act swiftly and decisively to protect consumers from potential harm. It is even more critical to be prepared and have a recall procedure in place, especially with the new 2009 reporting obligation under the FDA Amendments Act. The Manual is available from The Food Institute.

The "Food Product Recall Manual, 3rd Edition" provides an overview of the recall process and is intended to be a resource for firms that need guidance on their recall procedures. With the new administration, growing concerns about food safety, the increase in imported foods, and improved surveillance for foodborne illness outbreaks, proper recall measures are of great importance.

The revised Manual has a number of changes, including:

  • Discussion of the USDA/FSIS new recall directive -- FSIS's new recall directive includes several policy changes. For example, FSIS also has begun to publish names of consignees in meat and poultry recalls.
  • New reporting and recordkeeping requirements under the Bioterrorism Act, the FDA Amendments Act, and the Dietary Supplement and Nonprescription Drug Consumer Protection Act (DSNDCPA). These include the new reporting requirements discussed above, as well as a new requirement to report serious adverse events associated with dietary supplements.
  • New FDA and USDA food defense measures to prevent intentional adulteration of food.
  • Expanded discussion of certain Special Situations, which includes an expanded section on consumer product recalls involving the Consumer Product Safety Commission and added new sections on alcoholic beverage recalls and fresh produce recalls.
